Arson trial dismissed

Prosecutors in Iroquois County dismissed charges against a Fowler, Indiana woman in an arson case from 2017.  The State's Attorney's Office cited "substantial errors in the Fire Marshall's report" for the motion to dismiss the case. A bench trial was set to go Thursday in a case against 47-year-old Melissa Emery.  She was facing felony charges of residential arson and insurance fraud for a Sheldon house fire in June of 2017.  Court records pointed to evidence that Emery allegedly confessed to setting the fire, yet fire marshall Kevin Smith didn't recall the defendant making that statement. The defense also planned to argue that co-defendant Shuan Morgan had confessed to setting the fire. Dismissal of the case referred to significant flaws in the Fire Marshall's investigative report.
